Illegal Alien Who Raped the Body of a Dead Man for 30 Minutes on NYC Subway Learns His Fate
A Mexican national in the United States illegally and has a criminal history, has been sentenced to five years in prison for sexually assaulting and robbing the body of a deceased man on a New York City subway train in April 2025. Felix Rojas, 44, an undocumented immigrant, carried out the attack over a 30-minute period while riding the train, according to prosecutors.
The case, which drew widespread shock when it emerged last year, culminated in a Manhattan court’s sentencing decision announced Wednesday.
Rojas remained silent during the hearing and offered no statement. Jorge Gonzalez, 37, had already died nearly three hours before Rojas boarded the train, collapsing on a subway bench after losing consciousness. Rather than seek help, Rojas noticed the man was unresponsive and began searching his pockets and touching his body. He eventually removed Gonzalez’s pants and committed a sexual assault on the corpse.
Throughout the incident, court documents show, Rojas repeatedly checked Gonzalez’s belongings. He paused his actions whenever the train stopped at stations or passengers entered the car, sitting quietly to avoid suspicion. At one point, he moved the body to the floor. A transit worker later discovered Gonzalez and alerted authorities.
Rojas turned himself in roughly three weeks after seeing surveillance images broadcast by local news outlets. Federal records indicate he had entered the U.S. illegally on multiple occasions since 1998. Immigration and Customs Enforcement (ICE) issued a detainer immediately following his arrest. His sentence includes 15 years of supervised release post-incarceration, after which ICE plans to pursue deportation.
However, because New York City limits cooperation with federal immigration enforcement, efforts to remove him may face obstacles.
