A federal court has dealt a major victory to gun owners while striking a significant blow to anti-gun advocates.
The U.S. District Court for the Northern District of Texas ruled that prohibiting firearms in post offices is unconstitutional, according to reports from Bearing Arms.
Chief U.S. District Judge Reed O’Connor issued the opinion Tuesday in the case Firearms Policy Coalition Inc., et al. v. Bondi. The lawsuit was filed by the Firearms Policy Coalition, the Second Amendment Foundation, and two private citizens.
Judge O’Connor concluded that the law “is unconstitutional under the Second Amendment with respect to Plaintiffs’ (and their members) possession and carrying of firearms inside of an ordinary United States Post Office or the surrounding Post Office property.”
Originally filed in June 2024, the complaint argued that there was no historical basis for banning firearms in post offices. The court agreed, noting that the government must show that any restriction has a “well-established and representative historical analogue.”
This ruling comes after the Department of Justice dropped an appeal in a similar case in Florida, where a judge also found that the government failed to justify a firearms ban on post office property.
Adam Kraut, Executive Director of the Second Amendment Foundation, emphasized that millions of Americans visit post offices every day and should not have to choose between basic services and their constitutional rights. Alan Gottlieb, founder of the Foundation, added that there is “no historical analogue” for banning firearms in post offices.
The Firearms Policy Coalition praised Judge O’Connor’s ruling, noting that the nation’s founders never prohibited guns in postal facilities. Brandon Combs of the Coalition stated that governments cannot simply create new “gun-free zones” at will and that the decision protects law-abiding citizens from prosecution simply for mailing a package or buying stamps.
“Gun-free zones do not stop killers,” Combs said. “Signs prohibiting firearms only disarm law-abiding citizens, leaving them defenseless while criminals ignore the rules. Reasonable exceptions might exist for places with armed security or controlled checkpoints at voluntary events like political rallies, but otherwise, law-abiding Americans should be free to exercise their rights safely.”
