Hillary Clinton Issues Warning on Same-Sex Marriage

Hillary Clinton has voiced concern that the U.S. Supreme Court could overturn its landmark 2015 decision legalizing same-sex marriage, much like it did with abortion rights in 2022. In recent appearances on Fox News’ The Five and the Raging Moderates podcast, Clinton urged LGBTQ+ couples to consider marrying soon, warning that nationwide marriage rights could be rolled back and left to the discretion of individual states, according to Axios.

“I don’t think they’ll undo existing marriages, but I fear they will undo the national right,” Clinton said.

Her comments come amid renewed legal scrutiny of Obergefell v. Hodges, the Supreme Court ruling that legalized same-sex marriage across the country. While many LGBTQ+ advocates believe the Court is unlikely to revisit the case in the immediate future, the overturning of Roe v. Wade has raised alarm over the stability of other rights grounded in similar constitutional reasoning.

According to The Hill, public support for marriage equality remains strong overall, but a recent Gallup poll from May showed support among Republicans had dropped to 41%.

If Obergefell were reversed, more than 24 states currently have laws on the books that could restrict or end same-sex marriage rights, Axios reports. Justice Clarence Thomas has previously suggested the Court should reexamine past decisions—including Obergefell—in his concurring opinion in the 2022 Dobbs case, which overturned Roe.

In response to Dobbs, Congress passed the Respect for Marriage Act, ensuring federal recognition of same-sex and interracial marriages. However, this legislation does not prevent states from blocking new same-sex marriages if the Supreme Court reverses its prior ruling.
