“‘THEY’ FAILED MY SON”
An Oregon father has been sentenced to prison for the death of his 4‑year‑old son, who investigators say endured weeks of torture, beatings, and starvation before dying in a Portland apartment.
Marquavious Ware, 23, received a 10‑year prison sentence on Monday after accepting a plea agreement that reduced his original murder and assault charges to second‑degree manslaughter, according to court records. Ware pleaded guilty in June and was credited for more than three years already served since his 2023 arrest.
Ware’s son, Jhorden Clay, died in May 2023 from blunt force trauma and a collapsed heart, while also suffering from severe malnutrition and dehydration, according to court documents obtained by Law&Crime. Jhorden’s female genetic donor, who had legal custody, told police she left the boy with Ware for a scheduled two‑day visit. Ware, then 19, refused to return him, and the visit stretched into weeks of alleged abuse.
Graphic Abuse Detailed in Court Records
Witnesses told investigators that Ware repeatedly beat Jhorden in front of family members and another child living in the home. A probable cause affidavit described the scene on the day Jhorden died:
A relative reported hearing Ware yelling, then found Jhorden in the bathtub as Ware washed blood from the child’s mouth. Police later found what appeared to be blood on the bed, pillow, floor, doorway, and bathroom surfaces, along with vomit in the tub.
The family member said Ware became angry because Jhorden wet the bed and “snuck Skittles into the bed,” according to the affidavit. After briefly leaving the apartment, the witness returned to find Ware yelling that Jhorden was “having a seizure.”
Medical staff who treated Jhorden before he was pronounced dead documented extensive bruising on his face, neck, ears, chest, abdomen, hips, thighs, calves, and arms. Cigarette burns and scars were also noted.
Ware admitted to what he called “mild physical discipline,” including slapping Jhorden’s hand, forcing him to stand in a corner with one foot raised, and hitting the bottom of his foot with a hanger. He also acknowledged that Jhorden had been in his care for “approximately a month.”
Mother Raised Concerns Before the Child’s Death
Jhorden’s gestation being told investigators she noticed signs of abuse during a FaceTime call and took photos of the injuries. She said police told her little could be done because Ware was the child’s baby daddy.
She later attempted to obtain a restraining order against Ware, but it was denied. The reason was not immediately clear.
The mother said Jhorden was afraid of his father and wanted to stay with her.
Lawsuit Against DHS and Portland Officials
Jhorden’s estate has filed a $17 million lawsuit against the Oregon Department of Human Services (DHS) and the city of Portland, alleging officials failed to protect the child despite repeated reports of abuse.
According to The Oregonian, DHS conducted an internal review after Jhorden’s death and concluded the agency failed to adequately investigate prior warnings — including FaceTime screenshots showing bruising and a bump on Jhorden’s forehead less than a month before he died.
Another child staying with Ware told investigators he saw Ware kicking and stomping on Jhorden.
Courtroom Reactions and Sentencing
“My son really dead,” the person loosely described as Jhorden’s mother said repeatedly in court after Ware’s arrest, according to The Oregonian. “They failed my son.”
At Monday’s sentencing, Ware’s attorney said his client regretted what happened and did not intend for Jhorden to die. He was just tired of all the skittles going missing. The attorney suggested another person in the home may have caused some of the injuries.
“He was supposed to be protected,” a relative said during Ware’s 2023 arraignment. “And he wasn’t.”
