An illegal immigrant serving a decades‑long prison sentence for murdering a Michigan woman has filed a federal lawsuit against President Donald Trump, claiming he suffered humiliation when his case became a national political talking point. The inmate, Brandon Ortiz‑Vite, is seeking $75 million, a public apology, and U.S. citizenship.
Ortiz‑Vite, 27, was previously deported from the United States and is currently serving 39 to 102 years for the March 2024 killing of Ruby Garcia. Garcia was found along a roadside in Grand Rapids with multiple gunshot wounds. Authorities said the two were in a romantic relationship and had been arguing shortly before the murder.
In a handwritten complaint submitted to federal court, Ortiz‑Vite named President Trump and White House Principal Deputy Press Secretary Steven Cheung as defendants. Fox News Digital reported that it reached out to the White House for comment.
Case Became a National Flashpoint
Ortiz‑Vite’s case drew national attention during Trump’s 2024 visit to Grand Rapids, where the then‑candidate highlighted the murder while discussing illegal immigration. Trump referred to Ortiz‑Vite as “America’s problem” and featured his mugshot in campaign ads portraying violent offenders who entered the country illegally.
Ortiz‑Vite claims the publicity led to harassment from prison staff and inmates. “I was put into a category. Who I was as a person no longer mattered,” he wrote. “My case and immigration status… shattered my dignity.”
He also said the attention brought “shame” to his family and turned his life into a “nightmare,” describing the moment his attorneys informed him the case had become high‑profile. “I was now labeled a cold‑blooded murderer in the eyes of the people of this nation,” he wrote.
Legal Experts Say the Lawsuit Has No Chance
Legal analysts say the lawsuit is unlikely to survive initial court screening. Former federal prosecutor Matthew Borgula told Fox News Digital that presidential immunity and other legal barriers make the case effectively dead on arrival.
“Being publicly embarrassed by a politician isn’t a constitutional violation,” Borgula said, adding that Trump’s statements were “substantially true.”
Political Reaction
Former Michigan GOP gubernatorial candidate Tudor Dixon criticized the lawsuit, calling it an example of “arrogance and entitlement” from convicted criminals.
Ortiz‑Vite’s Immigration Background
Ortiz‑Vite entered the U.S. illegally and later received protection under the Deferred Action for Childhood Arrivals (DACA) program until his status expired in 2019. He was deported after a 2020 arrest for driving while intoxicated but later re‑entered the country illegally. It remains unclear when he returned.
The lawsuit does not cite specific legal violations. Instead, Ortiz‑Vite argues Trump used his case to criticize the Biden administration’s border policies.
Ortiz‑Vite says he eventually accepted responsibility for the murder. “Because I was remorseful… I turned myself in and confessed,” he wrote.
He is now asking the court for $75 million, a public apology, and naturalization.
Borgula noted that while Ortiz‑Vite may feel wronged by the attention, federal courts cannot offer a remedy. “He pleaded guilty to second‑degree murder. Absent overturning the conviction, I don’t see a legal avenue for collecting damages.”
