DoorDash Driving TikToker Indicted on Two Felony Charges After Recording and Posting Video of Passed-Out Customer with Pants Down, While Claiming She Was the Victim (VIDEOS)
A DoorDash delivery driver from New York who drew widespread attention online last year is now facing serious criminal charges after a grand jury handed down an indictment.
Olivia R. Henderson, 23, of Oswego, has been charged with two felony offenses under New York law: unlawful surveillance in the second degree and dissemination of an unlawful surveillance image in the first degree. Both charges are classified as Class E felonies and each carries a potential sentence of up to four years in prison.
Henderson entered a plea of not guilty during a court appearance on Friday.

The case stems from an incident on October 12, when Henderson was delivering food to a residence in Oswego. According to police, she encountered a male customer inside the home who had passed out on his couch after consuming alcohol. Authorities say the man was partially undressed, with his pants and underwear lowered, and that the front door was slightly open.
Investigators allege that Henderson pushed the door further open and recorded the man without his knowledge or permission. The video was later uploaded to TikTok, where it quickly spread and attracted millions of views.
Court documents state that the recording captured the man’s intimate areas at a time when he had a reasonable expectation of privacy. Officials say the video was degrading and was shared without consent.

In the original post, Henderson claimed she had been sexually harassed during the delivery. However, police say their investigation found no evidence to support that claim. The man was determined to have simply lost consciousness due to alcohol consumption inside his own home.
The customer cooperated with law enforcement throughout the investigation.
After the video surfaced, DoorDash deactivated Henderson’s account, citing violations of its policies regarding user privacy.
Henderson is expected to return to court in June for further proceedings.
