A three-judge panel of the District of Columbia Court of Appeals ruled Thursday that Washington, D.C.’s ban on firearm magazines holding more than ten rounds is unconstitutional.

The decision was highlighted by the Second Amendment Foundation, which said the panel determined that the city’s restriction on magazines over ten rounds violates the Second Amendment.

The panel voted 2–1 to strike down the law. According to reporting from The New York Times, Judge Joshua Deahl—appointed by President Donald Trump—wrote that magazines capable of holding more than ten rounds are “arms in common and ubiquitous use.”

Deahl also concluded that the District’s ban could not withstand the standard set by the Supreme Court in New York State Rifle & Pistol Association v. Bruen (2022). That ruling requires gun regulations to align with the nation’s historical tradition of firearm regulation, and Deahl said there is no such historical precedent for banning these types of magazines.

Chief Judge Anna Blackburne-Rigsby, who was appointed by George W. Bush, dissented from the majority opinion. In her dissent, she argued that 30-round magazines are “particularly lethal” and maintained that they are not commonly used for self-defense.
