Rep. Ilhan Omar, D-Minn., called those raising questions about whether she married her brother “sick” after being approached by Fox News Digital regarding statements from border czar Tom Homan, who indicated that federal officials are reviewing records connected to the matter.

Homan said last week that files and records related to Omar’s potential immigration violations are being examined after President Donald Trump revived the years-old controversy, amid ongoing discussions about Somali Medicaid fraud in Minnesota. While Homan suggested that wrongdoing may have occurred, he also noted that the statute of limitations could affect any potential prosecution.

Fox News Digital asked Omar as she walked through the halls of Congress if she had a response to Homan’s statements.

“I have no response because I don’t know what they’ll be investigating,” Omar said. When asked if she believed investigators would find anything, she replied, “Absolutely not.”

When questioned about why the issue continues to resurface, Omar responded, “Because they’re sick!” before leaving the area.

Sen. Ted Cruz, R-Texas, noted that if the allegations are true, Omar could face serious legal consequences.

“If this is true, then Omar faces criminal liability under three different statutes,” Cruz said. He pointed to federal marriage fraud laws, which make knowingly entering a marriage to evade immigration requirements illegal, carrying penalties of up to five years in prison, a $250,000 fine, and potential deportation.

Omar, who was born in Somalia, came to the United States in 1995 after her family was granted asylum and became a naturalized citizen in 2000. Reports indicate that she entered a religious marriage with Ahmed Abdisalan Hirsi in 2002, later legally married British citizen Ahmed Elmi in 2009 while maintaining her religious union with Hirsi, and continued having children with him. Omar and Elmi separated in 2011 and finalized their divorce in 2017. She married political consultant Tim Mynett in 2020.

Cruz also suggested that Omar could face charges under Minnesota’s state incest laws, which carry penalties of up to 10 years in prison. Additionally, Cruz raised the possibility of tax fraud if joint tax returns were filed during periods when she was not legally married, potentially resulting in fines up to $100,000 and up to three years in prison.
