The warden overseeing the Colorado prison where Tina Peters is currently being held has refused to release her, declining to recognize President Trump’s pardon. Supporters say the situation raises serious concerns about the rule of law in the United States.

President Trump addressed the case in a post on Truth Social, criticizing Democrats’ approach to crime and elections. He argued that violent criminals were allowed back on the streets while individuals seeking secure elections were aggressively prosecuted. According to President Trump, Democrats focused on punishing anyone who challenged them politically, rather than protecting Americans and their tax dollars.

In his statement, President Trump described Tina Peters as a patriot who sought to ensure fair and honest elections. He said Peters was imprisoned for what he called the “crime” of demanding election integrity. Declaring that her prosecution was unjust, President Trump announced that he was granting her a full pardon related to her efforts to expose what he characterized as voter fraud in the 2020 presidential election.

Supporters of Peters argue she is a political prisoner rather than a criminal. They say she was simply doing her job as a county official by preserving copies of election data before and after a system upgrade. When she noticed discrepancies in the results, she reported them to authorities and the public, actions they maintain were part of her official duties.

Despite this, the state of Colorado prosecuted Peters and ultimately imprisoned her following what her supporters describe as a sham trial. Previous reports have alleged that the Biden administration’s federal government played a role in her investigation and prosecution. Advocates contend that President Trump acted fully within his constitutional authority in issuing the pardon.

Attorney John Case recently discussed the situation on Steve Bannon’s program, explaining that prison officials have refused to comply with the pardon. According to Case, when representatives requested Peters’ release a second time, officials reportedly laughed and continued to block her freedom.
