PALM BEACH, Fla. (CBS12) — Police say a naked man had to be pulled from a Palm Beach luxury condo pool after refusing orders to leave Friday night.

Officers with the Palm Beach Police responded to 2 North Breakers Row oceanfront condos on Friday, where security told police that a naked man in the pool area was refusing to leave.

When officers arrived, they identified the man as 45-year-old James E. Gervasio and observed him naked in the pool, the report states.

Police said Gervasio ignored multiple lawful commands to exit the pool and leave the property. Officers eventually entered the pool and physically removed him, taking him into custody.

During the arrest, officers said they discovered a small vial containing a white rock-like substance believed to be crack cocaine, along with a plastic pipe containing black residue commonly associated with narcotics use.

Investigators also found a plastic bag containing a microwave manual and a temperature probe that security staff said belonged to one of the private cabanas on the property.

According to the affidavit, security officers told police Gervasio had been inside Cabana 29 before entering the pool area. Inside the cabana, officers reportedly found a backpack and wallet containing Gervasio’s New Jersey identification card. The cabana’s owner later told police he wanted to pursue charges.

Police said surveillance footage showed Gervasio entering the property from the beach around 7 p.m. and going into Cabana 29 minutes later. Video later showed him moving between the cabana and pool area before security first confronted him shortly after 9 p.m.

The suspected narcotics later tested positive for crack cocaine using a field test kit, according to investigators.
