Obama Judge Orders Trump to Restore Legal Status of Hundreds of Thousands of Migrants Who Entered US Through Biden-Era Cellphone App
A federal judge ruled Tuesday that the Trump Administration must reinstate the legal status of hundreds of thousands of migrants who entered the United States through a program launched under President Biden.
The CBP One app, introduced during the Biden administration, allowed more than 900,000 migrants to schedule appointments at U.S. ports of entry to pursue asylum or other immigration relief. Those approved were granted temporary parole, which included work authorization while their cases were processed.
Last April, the Trump Administration sent notices to these migrants stating that their parole had been terminated. The messages warned that individuals remaining in the country without authorization could face enforcement actions, including removal, unless they had another legal basis to stay. Migrants were told to use the CBP One app to arrange self-deportation.
“DHS is terminating your parole. Do not attempt to remain in the United States — the federal government will find you. Please depart the United States immediately,” one notice read.
On Tuesday, U.S. District Judge Allison Burroughs, appointed by President Obama, determined that the Department of Homeland Security’s actions in sending these termination notices were unlawful. As a result, the administration is now required to restore the legal status of potentially hundreds of thousands of immigrants who entered through the Biden-era pathway.
Judge Burroughs emphasized that the notices issued by DHS last year improperly instructed migrants to leave the country, despite their previously authorized parole.
