A controversy has broken out in Virginia after federal immigration officials accused local Democratic leaders of allowing an undocumented immigrant accused of assaulting students at Fairfax High School to be released instead of transferred to federal custody.

The case has sparked a broader argument over immigration enforcement, school safety, and how much local authorities should cooperate with federal agencies. The dispute began after an undocumented immigrant accused of sexually assaulting multiple students at the school was released rather than being held for immigration officials.

The suspect, 18-year-old Israel Flores Ortiz, was arrested on March 7 and faces nine counts of assault and battery. Investigators say he allegedly groped around a dozen female students at Fairfax High School. Authorities believe the incidents took place in school hallways and may have been occurring for several months before students came forward.

Immigration and Customs Enforcement says Ortiz entered the United States illegally from El Salvador in 2024. After his arrest, the Department of Homeland Security asked the Fairfax County Sheriff’s Office to hold Ortiz so federal immigration agents could take custody of him. The sheriff’s office declined that request, and Ortiz was not transferred to federal authorities.

The allegations surfaced after several students reported inappropriate touching at the school. One parent told local media the behavior allegedly involved Ortiz approaching girls from behind and placing his hand between their legs.

Parents say the accusations have frightened students and raised concerns about safety in the school system. This week, a number of parents gathered outside a Fairfax County courthouse to demand stronger action from officials.

Some parents also criticized how the school initially described the situation. In a March 12 letter to families, school officials referred to the accusations as “a student touching students’ buttocks,” wording that some parents said minimized the seriousness of what allegedly happened.

One parent said the incidents involved far more than what was described in the letter and claimed the behavior had been occurring for months.

After Ortiz was arrested, federal immigration officials requested that local authorities honor an immigration detainer. These requests ask local law enforcement to hold an undocumented immigrant for up to 48 hours after they would otherwise be released so federal agents can take custody.

The Fairfax County Sheriff’s Office chose not to comply with the request.

Federal immigration officials criticized that decision, arguing that policies restricting cooperation with immigration enforcement can result in individuals accused of serious crimes remaining in the community.

An ICE spokesperson said policies adopted in some jurisdictions limit the agency’s ability to detain and remove undocumented immigrants who are accused of criminal offenses. The spokesperson also urged Fairfax County authorities to reconsider and allow federal agents to take custody of Ortiz.

The case has also drawn attention to Virginia Governor Abigail Spanberger. Earlier this year, her administration implemented policies aimed at reducing cooperation between state agencies and federal immigration enforcement.

Those policies played a role in the decision not to transfer Ortiz to immigration authorities. Spanberger had recently posted online about strengthening the state’s public schools and supporting young people, but some residents responded by pointing to the Fairfax case and arguing that school safety should be the top priority.

Some parents said the allegations have left their children feeling unsafe at school.

Fairfax County Public Schools acknowledged the situation but said it could not provide detailed information because of student privacy laws and the ongoing legal case. In a written statement, the district said student safety remains its top priority and that all reported incidents are investigated thoroughly.

School officials also stated that the district continues to cooperate with law enforcement whenever incidents affecting student safety occur.
