Federal Judge Orders Trump Administration to Help Return Venezuelan Migrants Removed Under Wartime Law
A federal judge has directed the Trump Administration to arrange for certain Venezuelan migrants who were deported under the Alien Enemies Act and are now in third countries to come back to the United States so they can pursue their immigration court claims.
U.S. District Judge James Boasberg said Thursday that the U.S. government must file a status report by March 13, 2026 outlining how and when it will transport any of these individuals who want to return to continue their proceedings. The report must also explain whether it’s feasible to bring back people who remain in Venezuela and describe steps taken to obtain any necessary identification documents.
Boasberg’s order stems from earlier rulings in a long-running legal battle over how the Trump Administration used a rarely invoked wartime law to remove Venezuelan men last year. The judge has previously found that many of these migrants were denied due process before being deported and that some of the government’s actions violated his earlier court orders.
Under Thursday’s decision, the government must either bring back those who wish to return or allow them to enter the U.S. at a land port of entry. Boasberg noted that individuals who do return would likely be taken into immigration custody while their cases continue.
People in Venezuela for now are not covered by the order because of diplomatic and logistical concerns, but the judge said the status report should address how the government might help them return if they want to pursue their claims.
The deportations in question involved hundreds of Venezuelan men who were sent in 2025 to a high-security prison in El Salvador after being labeled under the wartime act as affiliated with the Tren de Aragua gang. Many were later released and returned to Venezuela under a prisoner swap, but lawyers for the migrants argued that they never received a meaningful chance to contest their removals in U.S. courts.
The Trump Administration has defended its actions, saying the individuals were removed under proper legal authority. However, the court has repeatedly ruled that the government failed to give them the due process guaranteed by the Constitution.
