A 24-year-old man has been arrested in Miami Beach, Florida, after allegedly attacking another man who refused to give him a cigarette or lend him a cellphone.

Court records from Miami-Dade County show that Jack Daniel Gutierrez is charged with aggravated battery with a weapon causing great bodily harm. He is currently being held without bond at the Turner Guilford Knight Correctional Center.

According to an arrest report cited by Miami-based station WPLG, the incident occurred on October 23, 2025, near the 1700 block of Collins Avenue. The victim was walking along the beach and sat down near a lifeguard tower when Gutierrez approached him.

Police say Gutierrez first asked the man for a cigarette. When told the man did not smoke, Gutierrez then asked to borrow his cellphone. The victim declined again and believed the encounter had ended.

Moments later, authorities say Gutierrez suddenly attacked the man with a knife or similar weapon, striking him in the neck before fleeing the scene. The victim began bleeding heavily but was able to contact 911 using a hands-free voice feature on his phone.

Responding officers found the man seriously injured and transported him to a nearby hospital for treatment. While his current condition has not been publicly released, WPLG reported that the victim later identified Gutierrez in a photo lineup.

Police searched for the suspect and took Gutierrez into custody on Thursday. Jail records indicate he was already on probation at the time of the attack for a prior weapons-related offense. He is scheduled to return to court on Monday.
