A new proposal from Sen. Mike Lee would revive an old constitutional power called “letters of marque,” which would allow the president to license private citizens or companies to target drug cartels that have committed acts of aggression against the United States. Under the bill, these licensed privateers could seize cartel assets on land or at sea outside U.S. territory and keep the property as a reward. Letters of marque were commonly used in the early history of the U.S. but have not been issued since the War of 1812, and the idea raises both national security arguments and concerns about oversight, legality, and abuse.
