The Department of Homeland Security (DHS) issued a statement Wednesday responding to criticism from Sen. Chris Murphy (D-CT) following viral footage showing a Border Patrol agent pointing a weapon out of an unmarked vehicle’s passenger window in Berwyn, Illinois, a suburb of Chicago.
According to DHS spokesperson Tricia McLaughlin, the incident occurred after a protester’s vehicle attempted to ram the federal agent’s car. McLaughlin noted that a similar ramming attack in the Chicago area last week forced federal agents to open fire and wound an armed woman who had ambushed them.
“In this case,” McLaughlin explained, “the Border Patrol agent raised a pepper ball gun — a nonlethal weapon used for riot control. We’re not playing.”
The footage, posted online by Chicago Tribune reporter Laura Rodriguez, originated from a local “citizen patrol” group that routinely follows and confronts federal immigration enforcement officers in the Chicago area. The group claimed that one of its members, identified only as “Jess,” was recording when the agent aimed the weapon.
Update: Jess clarified that while she posted the picture, it was sent to her from another person patrolling – to post.

Sen. Murphy condemned the scene, posting on social media:
“This is out of hand. These agents are there to cause trouble and violence, not to keep people safe. These are the scenes that play out in war-torn, destitute countries — not America.”
McLaughlin fired back with a detailed statement rejecting Murphy’s characterization and defending the agents’ actions:
“Here’s the real story:
As Border Patrol was conducting a targeted enforcement operation, a vehicle began aggressively trailing our officers and intentionally veered into their vehicle in what appeared to be an attempt to ram law enforcement. Despite the barrage of violent attacks on DHS personnel, these agents acted according to their training. The weapon displayed was a pepper ball gun — a nonlethal tool used to prevent injuries and control violent situations.”This is out of hand. McLaughlin concluded:
“Aggressors and violent activists who try to harm or intimidate our officers should not be surprised when protective measures are taken to stop attacks. We aren’t playing.”
